Diddy denied bail, will remain in jail until sentencing

(NewsNation) — A federal judge has denied Sean “Diddy” Combs’ request for release from jail as he awaits sentencing in October for a prostitution-related conviction.

"Combs fails to satisfy his burden to demonstrate an entitlement to release," Judge Arun Subramanian wrote in his Monday ruling.

He wrote that during the trial, the defense conceded Combs' history of violence in his personal relationships.

"This type of violence, which happens behind closed doors ... is impossible to police with conditions. On this basis alone, Combs’s application is denied," he wrote.

Diddy again asks for bail citing ‘exceptional circumstances’

Combs’ attorneys had filed a bail motion last week saying there are “exceptional circumstances” that warrant his release.  

They argued in their motion to Subramanian that Combs is the only person with a similar conviction under the Mann Act to remain incarcerated. 

“In the history of the statute, the Mann Act has never been applied to facts similar to these to prosecute or incarcerate any other person,” they wrote. “In any somewhat similarly situated cases to this one, all the defendants were released pending sentencing.” 

A jury convicted Combs on two counts of transportation to engage in prostitution under the Mann Act, which has a maximum sentence of 10 years in prison. He was acquitted of the more serious charges of racketeering and sex trafficking.

Subramanian denied Combs’ initial request to be released on bond after the split verdict. He said the applicable law didn’t allow for Combs’ release, saying evidence at trial showed the music producer’s “pattern of violence” toward ex-partners. 

His sentencing hearing is scheduled Oct. 3.

Diddy facing threats of violence inside Brooklyn jail

Combs is being held at the Metropolitan Detention Center in Brooklyn.

In the defense's request for bail, Combs' attorneys stated they "... are aware of ongoing threats of violence and actual violence in the facility, such that Mr. Combs’ safety is constantly at risk.

In Monday's order, the judge responded that, "... MDC staff has been able to keep him safe and attend to his needs, even during an incident of threatened violence from an inmate."

Diddy's defense claims ex-girlfriends were 'swingers'

In the bail motion, Combs’ attorneys also took aim at his ex-girlfriends, who were the basis of the criminal charges. 

They said both Casandra “Cassie” Ventura and a victim known under the pseudonym “Jane” were "swingers" who engaged in “threesomes” with Combs and initiated contact with sex workers.

“This was a lifestyle, one that both Ms. Ventura and Jane chose. One they all—as grown adults—had a right to choose,” they said.

Additionally, attorneys argued that Combs should be released because the conditions of confinement at the Metropolitan Detention Center in Brooklyn, where he is currently being held, are unsafe. 

The attorneys appear to be pulling every lever they can as they also filed a motion Wednesday asking Subramanian to set aside a jury verdict convicting him on federal prostitution charges or to grant him a new trial on those charges alone. 

Combs’ lawyers used many of the same arguments as his bail motion, saying the prostitution convictions under the Mann Act are legally unsupported, constitutionally flawed and inconsistent with longstanding Department of Justice policy.
