(NewsNation) — Riverside County District Attorney Mike Hestrin lambasted a judge over a decision that kept missing 7-month-old Emmanuel Haro's father out of prison.

Emmanuel's father, Jake Haro, was given a suspended sentence in 2018 for a separate child abuse case, allowing him to avoid prison. The child was left with numerous injuries and is now permanently bedridden.

"If that judge had done his job … Emmanuel would be alive today," Hestrin said.

Riverside County Sheriff Chad Bianco echoed the sentiment, saying the baby's death was "preventable in numerous ways."

Officials said they believe the child was abused over time and died of his injuries.

For the time being, the case remains a no-body homicide; however, officials are confident in their ability to get a conviction.
