Hong Kong issues first HK$3,000 fine as construction site smoking ban takes effect

Hong Kong has enforced a blanket smoking ban at construction sites, with authorities issuing one HK$3,000 fixed penalty notice as of noon on the first day of the new policy.

The Labour Department is expected to inspect over 100 construction sites across the city on Friday. As of noon, officers had visited 58 sites and issued one penalty notice, according to Commissioner for Labour Sam Hui.

The new rule designates all types of construction sites – including those for building repair, maintenance or renovation – as no smoking areas. Offenders face a fixed fine of HK$3,000.

Contractors responsible for construction works are required to ensure that no one smokes on their sites, with those failing to do so facing a maximum fine of HK$400,000.

Hui said the authorities would not offer a grace period or issue warnings before taking enforcement action: “We will strictly enforce the law without an adjustment period or issuing prior warnings,” he told reporters in Cantonese.

The smoking ban is among a number of measures that the government proposed in the wake of the deadly Tai Po fire last November, which killed 168 people and displaced thousands in one of the worst blazes in Hong Kong history.

Authorities previously said that the blaze was most likely caused by smoking, citing the findings of a cross-departmental investigation.

In a statement on Friday, the government said it had launched a series of publicity campaigns to raise awareness in the construction industry and among the public regarding the new rule.

The Labour Department will work with other government agencies to promote a smoke-free culture and support people to quit smoking, the government said.

Hui said on Friday that authorities considered the HK$3,000 fine to be effective in deterring smoking on construction sites, but it would be subject to review.

He added that the government encouraged construction contractors to reward workers who had successfully quit smoking to promote a smoke-free culture.
